Facebook Ads Lead Generation Services Agreement and Terms of Service

(Revised for One-Time and Recurring Offers – Neighborhood Leads)

1. Acceptance of Agreement

By contracting for 411 Locals' Facebook Ads Lead Generation Services ("Services") and entering into this Facebook Ads Lead Generation Services Agreement ("Agreement"), you represent and warrant that:

  • You are at least eighteen (18) years of age;
  • You have provided true, accurate, current, and complete information;
  • You have the authority to enter into this Agreement on behalf of the entity listed; and
  • You agree to be bound by this Agreement and comply with all applicable laws, rules, statutes, ordinances, regulations, and orders.

By purchasing or using the Services, you acknowledge that this Agreement incorporates by reference 411 Locals' most current General Terms of Service and Privacy Policy, available at:

411 Locals reserves the right to update these Terms of Service at any time by posting revisions on its website. Continued use of the Services following any such update constitutes acceptance of the revised terms.

2. Services and Billing Terms

a. Service Structure

411 Locals offers Facebook Ads lead generation under two possible commercial structures, which will be clearly disclosed at the point of sale:

  1. One-Time Prepaid Lead Package
  2. Recurring Lead Delivery (Subscription or Refill-Based)

Your purchase confirmation, invoice, or order summary defines which structure applies to your account.

b. One-Time Prepaid Lead Package

If you purchase a one-time lead package, you agree to the following:

  • You will be charged a one-time, non-refundable fee (e.g., $300) for a predefined quantity of leads.
  • Leads will be delivered over a commercially reasonable period determined by market conditions, ad performance, and targeting constraints.
  • No guarantees are made regarding delivery speed, customer intent, contact success, or conversion outcomes.
  • All fees are earned upon purchase and non-refundable, regardless of lead utilization or business results.
  • Once the purchased lead quantity is delivered, no further billing occurs unless you explicitly purchase additional lead packages or enroll in a recurring plan.

c. Recurring Lead Delivery / Refill Programs

If you enroll in a recurring lead program, you agree that:

  • You authorize 411 Locals to charge your payment method on file on a recurring basis (monthly or per refill cycle as disclosed at sale).
  • Pricing may be a flat monthly amount, a fixed refill amount, or another disclosed structure (e.g., $300 per refill).
  • Recurring charges continue until canceled by the authorized account holder via phone at (866) 391-0622.
  • No cancellations are accepted via email or written correspondence.
  • All charges incurred prior to cancellation are non-refundable.

411 Locals reserves the right to modify pricing for future billing cycles with at least ten (10) days' notice.

d. Lead Nature and Disclaimer

Leads may include, but are not limited to: name, phone number, email address, location, and service request details. Lead content may vary.

411 Locals makes no representations or warranties regarding:

  • Customer intent or seriousness
  • Ability or willingness of a customer to hire you
  • Accuracy or completeness of customer-provided information
  • Your ability to contact or convert any lead
  • Revenue, job volume, or return on investment

411 Locals does not guarantee any minimum number of leads unless explicitly stated in writing at the point of sale.

411 Locals is not a party to, nor responsible for, any contracts, payments, disputes, or outcomes between you and your customers.

e. Lead Delivery

Leads may be delivered via:

  • SMS/text message
  • Email
  • Customer dashboard or CRM access

Delivery method is subject to operational availability and may change without notice.

f. Reporting

For recurring accounts, 411 Locals will provide a lead activity report by the following billing cycle outlining delivered leads and corresponding charges.

g. Credits (If Applicable)

Credits, if offered, are granted solely at 411 Locals' discretion and must be requested within seventy-two (72) hours of lead delivery notification.

Credits may be considered only for the following reasons:

  • Lead is outside your defined service area
  • Lead is categorized for a service you do not offer
  • Duplicate lead previously charged

No credits will be issued for:

  • Inability to contact a lead
  • Incorrect or incomplete contact information
  • Customer disinterest or non-responsiveness

Credits, if approved, will be applied as an account balance and not refunded in cash.

3. Communications Consent

You consent to receive communications from 411 Locals via phone, SMS, email, auto-dialer, or other electronic means related to your account and services.

411 Locals will not sell your information to unaffiliated third parties.

4. Indemnification and Limitation of Liability

You agree to indemnify and hold harmless 411 Locals, its affiliates, officers, directors, agents, and employees from any claims, damages, liabilities, or expenses arising from:

  • Leads provided
  • Customer interactions
  • Services rendered by you
  • Content or information you submit or publish

To the maximum extent permitted by law, 411 Locals disclaims all liability for direct, indirect, incidental, consequential, or special damages, including lost profits or business interruption.

5. Entire Agreement

This Agreement constitutes the entire understanding between the parties and supersedes all prior discussions or agreements, whether written or oral.

Any ambiguity shall not be construed against 411 Locals.

6. Governing Law and Jurisdiction

This Agreement is governed by the laws of the State of Nevada.

Exclusive venue for any dispute shall be the courts of Clark County, Las Vegas, Nevada.
